The Award places an emphasis on the resolution of disputes at the workplace. The State Award (Clause 37) also provides that a formal grievance is to be submitted in writing.
Relief Duties and Higher Grade pay:
The USU has been in dispute with Tamworth Region Council over a grading issue for our members at the Tamworth Landfill site in relation to the grading of the Position Description that the staff are appointed to at the landfill. The current Position Description (PD) for operator – landfill under the Directorate of Water and Waste is classified at Grade 6. However, the duties performed by the employees aligned with those of a specialist Operator – Grade 8.
Operating Heavy Plant:
- Front End Loader
- Compactor
- Dozer
- Excavator
The Union members filed a USU Grievance form with the Council in relation to the Grading issues.
The way to settle disputes and grievances will differ from case to case.
In this case, the Union had to file a dispute before the Industrial Relations Commission.
Out of the Conciliation proceedings before the Industrial Relations Commission, and a vote with the members to accept the offer, we have now resolved the matter, and our members will receive a lump sum payment as a full and final payment. This is a great outcome for our members and confirms the importance of the Union and its members using the grievances process in the Award.
